    Costa Rican Congressman Introduces New 'Sextortion' Bill with Penalties

    The Costa Rica News (TCRN) โ€“ Deputy Jose Alfaro presented a bill on Tuesday to sanction what they call โ€œrevenge pornโ€ or โ€œsextortionโ€ which refers to the spread ofย sexually explicit imagesย of people without their consent in order to damage their reputation.

    The bill amends the Criminal Code to modify Article 196 to allow a punishment of up to four years in prison by violating someoneโ€™s privacy with, โ€œInformation, data or video images from one or more identifiable persons, and without the consent of them in total or partial nudity, sexually explicit or erotic situations that were not designed for public disclosure.โ€

    According to Alfaro, the initiative comes after the recent cases that have occurred regarding the theft of images from artists and models without their consent.

    โ€œWe saw the sad case of the former deputy minister of youth that a sex tape released without his consent as revenge and thatโ€™s what we want to penalizeโ€ said the congressman.

    He added that at this time the offense does not have any penalty, so it must be regulated.

    However, the project does not explain what will happen when the images are stolen from a mobile device (a cell phone, for example) or determine who was actually released those images or videos.
